Conditions for the Provision of Personal Data

Basic Provisions Regarding the Processing and Protection of Your Data (Privacy Policy)

AUDIOLENDER invests all necessary resources and applies the strictest measures to protect the security and integrity of all personal data collected from our customers. We follow the principles of lawful, fair and transparent processing of personal data for our customers.

Therefore, we collect and process the provided data only for specific, explicitly stated and legitimate purposes and do not process them further in a way that is incompatible with these purposes.

We have implemented systems and processes to ensure that the data we collect and store are kept to a minimum and are related to and limited to only what is necessary to fulfill the purposes for which we collected them. We strive to keep your personal data always accurate and up-to-date, and we rely on you to inform us if you find any inaccuracies in your data so that we can promptly correct them.

“HERACLES - 2018” EOOD, EIK 205291405, with its registered office and address of management: Sofia, Sofia, Iskar district, bl. 45, entrance E, floor 3 is a company registered in Bulgaria, which through the AUDIOLENDER platform, is a data controller, according to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

We assure you that we have implemented systems to ensure that we do not store your data for a period longer than necessary for the purposes for which they are processed.

We also draw your attention to the possibility at any time and without the need to justify yourself to withdraw your consent to process your data and delete them if you wish, unless there are other lawful grounds to keep them. Since it is our priority to process in a way that ensures the appropriate level of security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, we have implemented security mechanisms and restricted access.

AUDIOLENDER IS A DATA CONTROLLER AND COMPLIES WITH THE PROVISIONS OF THE APPLICABLE LEGISLATION (GENERAL DATA PROTECTION REGULATION - REGULATION (EU) 2016/679, DATA PROTECTION LAW AND OTHERS).

PERSONAL DATA AND PROCESSING OF PERSONAL DATA

Personal data are any information relating to an identified or identifiable natural person. This includes your name, EGN (LNC), email address, phone number, postal address, etc.

Processing means any operation or set of operations performed on personal data or a set of personal data by automatic or other means for collecting, recording, organizing, structuring, storing, adapting or changing, retrieving, consulting, using, disclosing by transmission, dissemination or any other way in which the data become accessible, arranging or combining, restricting, deleting or destroying.

PERSONAL DATA COLLECTED AND PROCESSED BY AUDIOLENDER. PURPOSES OF PROCESSING

We collect your data on a voluntary basis when you provide them to us, with a view to your expressed desire to enter into a contract for the services we provide. After the conclusion of the Agreement, your data will be processed in your capacity as a party to this Agreement and in connection with the fulfillment of our obligations under it. The provision of these data allows to identify the respective person as a party to the contract and as the holder of rights/obligations under it. The three names, the unique civil number and the address of the person are part of the minimum content of each contract. If a person refuses to provide them, AUDIOLENDER will not be able to conclude a contract. In order to be able to fulfill the concluded contracts, it is necessary to process the personal data of the persons with whom we have concluded them. Otherwise, it will be impossible to comply with our contractual commitments.

  • We process personal data when it is necessary to exercise our rights under concluded contracts, as well as when it is necessary to settle legal disputes.
  • We process personal data when, in accordance with the applicable legislation, we are obliged to provide information to competent authorities.
  • We process personal data to fulfill obligations arising from accounting and tax legislation - in Bulgaria it requires the preparation of certain accounting and commercial information, including the storage of this information for a certain period, as well as any other information and documents of importance for taxation. When fulfilling this obligation, the relevant information and documents containing personal data are stored for periods specified in the relevant laws.

Data Transfer, Including to Countries Outside the EU

AUDIOLENDER does not share, sell, rent, trade, or transfer personal information collected from its customers.

By exception and with a legal basis, your personal data may be disclosed to third parties in the following way:

  • It may be transferred as an asset in connection with a merger or sale of the business or as part of our business or as part of a corporate reorganization or other changes in corporate governance.

Service providers are not permitted to retain the data for their own use or to use the data outside of our instructions, or to retain it for longer than is necessary to perform the specified service.

In the event of data transfer, AUDIOLENDER requires third parties, customers, employees, and partners to maintain the confidentiality of the information and to commit to using your personal data only for the agreed purposes and never use it to identify you as a person, to contact you, or to send you messages outside of the purposes for which they are provided to them. Third parties or partners will only be allowed to receive the information they need to perform their functions on our behalf. In addition, they must process personal data in accordance with and in compliance with AUDIOLENDER's privacy policy, as well as applicable data protection laws.

In connection with the above, regarding the sharing of your information, we inform you that your data will not be transferred or processed outside the EU.

Your personal data may be provided to government agencies only when provided for by law and under the conditions specified therein.

Data Retention Period

We will keep your personal data for as long as is necessary to fulfill the purposes and prove their fulfillment or in accordance with your instructions and desire to withdraw your consent to process your data and have them deleted.

Your Rights Regarding the Personal Data You Provide

1. Right to Information

  • You have the right to request information at any time:
  • Whether your personal data are stored;
  • The purposes for which they are processed;
  • What categories of personal data are processed;
  • The recipients to whom the personal data have been disclosed;
  • The envisaged period for which they will be stored;
  • Whether automated decision-making and profiling of data exist.

2. Right to Withdrawal

If you have given consent for the use of your data, you can withdraw it at any time with effect for the future, without having to give reasons.

3. Right to Correction

If you discover that the data you have provided to us are inaccurate, you can contact us to have them corrected.

4. Right to Erasure

You have the right to request that we erase your data without undue delay. We will erase them within a reasonable period of time, immediately after we have ensured that there are no other grounds that require their processing/storage.

After the deletion of your personal data, it is no longer possible to provide information about them from our side.

5. Right to Restriction of Processing

In certain cases – for example, if you challenge the accuracy of the data, check the grounds for their storage, etc., you have the right to request that we restrict the processing of your personal data. During the restriction period, we can only store the personal data, and the remaining processing activities are only possible with your consent.

6. Right to Data Portability

If you request it, we will transfer or transfer the data to you or another controller in a structured, widely used and machine-readable format. Direct data transfer is only carried out if it is technically feasible.

7. Right to Object

You can object to the processing of your personal data for the purposes of direct marketing, including profiling, at any time and without giving reasons, as well as in cases where your data are processed on the basis of the performance of a public task or processing is necessary for the purposes of our legitimate interests.

8. Right not to be subject to a decision based solely on automated data processing, including profiling.

At the present time, AUDIOLENDER does not carry out automated data processing. Including profiling.

9. Right to Complaint

You have the right to file a complaint against the processing of your personal data with the competent supervisory authority – the Commission for Personal Data Protection or the Court if you believe that your rights to personal data protection have been violated.

Please note that when you contact us through the email [email protected], the data you provide (your email, name, and phone number) will be processed by us to answer your questions and resolve any issues. We commit to delete the retained data related to this once its processing is no longer necessary, or we will limit the processing if there are legal obligations for retention.

The current terms are composed in Bulgarian and English. In case of a conflict in the text, the Bulgarian version will prevail.
